If you sell or get rid of a motor vehicle that is subject to a confiscation order, you are committing an offence. This applies when the motor vehicle has not yet been surrendered to, or seized by, a Registrar, bailiff, or constable, and is subject to an order under sections like sections 128(3), 129(3), 129A(3), and 136(4). You can be fined up to $2,000 if you are convicted of selling or disposing of the motor vehicle or any part of it.

132AOffence to sell or dispose of motor vehicle subject to confiscation order

  1. This section applies in any case where a motor vehicle—

  2. is subject to an order under any of sections 128(3), 129(3), 129A(3), and 136(4); but
    1. has not yet been surrendered to, or seized by, a Registrar, bailiff, or constable.

      1. Every person commits an offence, and is liable on conviction to a fine not exceeding $2,000, who sells or disposes of the motor vehicle or any part of the motor vehicle.
