57A: Court may defer commencement date of sentence of community work

If you get a sentence of community work and another sentence, the court can delay when you start the community work. This can happen if you also get a sentence of intensive supervision or home detention. The court can delay the community work if it thinks this will help you follow the rules of your other sentence.

The rules you must follow depend on your other sentence. If you get intensive supervision, you must follow the conditions in section 54F, 54G, or 54I. If you get home detention, you must follow the conditions in section 80C or 80D.

The court decides how long to delay your community work. It does this to help you comply with the conditions of your other sentence. You will start your community work after the delay is over.

57ACourt may defer commencement date of sentence of community work

  1. If a court imposes both a sentence of community work and a sentence of either intensive supervision or home detention, the court may defer the commencement of the sentence of community work for a specified period if, in its opinion, deferral is necessary to enable the offender to comply with—

  2. in the case of a sentence of intensive supervision, any conditions imposed under section 54F, 54G, or 54I:
    1. in the case of a sentence of home detention, any conditions imposed under section 80C or 80D.
