If you have to do community work as part of your sentence, the chief executive of the Department of Corrections can let probation officers reduce your hours during an epidemic. They can reduce your hours by up to 8 hours a week. They can also reduce your total hours by up to 48 hours or one-third of your sentence, whichever is less.

The chief executive of the Department of Corrections makes this decision, and it does not mean you automatically get a reduction in your community work hours. This is decided on a case-by-case basis. You do not have a right to a reduction in your community work hours just because of this rule.

The rule about reducing community work hours during an epidemic is part of the Sentencing Act 2002, which was amended by the Sentencing Amendment Act (No 2) 2006.

67ARemission of community work hours during epidemic

  1. While an epidemic management notice is in force, the chief executive of the Department of Corrections may authorise probation officers to remit the hours of community work imposed by the court on offenders, for periods (in any individual case)—

  2. of not more than 8 hours in any week; and
    1. of not more in total than the lesser of 48 hours and one-third of the sentence imposed.
      1. This section does not give any offender a right to a remission.
