If you are serving a sentence of home detention and you get another sentence, subsection 2 applies. This happens if your new sentence is a prison term of more than 12 months, or if you get two or more prison terms at the same time that add up to more than 12 months, or if you get two or more prison terms that you serve one after the other and they add up to more than 12 months. If this section applies to you, your home detention sentence is suspended.

Home detention

80ZGAEffect of subsequent sentence of imprisonment of more than 12 months

  1. Subsection (2) applies if an offender who is subject to a sentence of home detention is subsequently sentenced to—

  2. a term of imprisonment of more than 12 months; or
    1. 2 or more terms of imprisonment to be served concurrently, the total term of which is more than 12 months; or
      1. 2 or more terms of imprisonment that are cumulative, the total term of which is more than 12 months.
        1. If this section applies, the sentence of home detention is suspended.
