59Best obtainable information
In this subpart, the best obtainable information means information that the decision maker is satisfied—
- is as robust, transparent, and accessible as reasonably possible; and
- is obtained from information that is available or can be reasonably obtained at the time; and
- is obtained in a manner that is proportionate to the effects of the decision.
When considering whether information is the best obtainable information, the decision maker must be guided by any criteria prescribed in regulations but is subject to section 52(5).
