19Restrictions on use of beds of rivers and lakes

  1. A person must not do any of the following activities in relation to the bed of a river or lake unless the activity is expressly allowed by an instrument specified in subsection (2) or a permit:

  2. use, erect, reconstruct, place, alter, extend, remove, or demolish any structure or part of any structure in, on, under, or over the bed:
    1. excavate, drill, tunnel, or otherwise disturb the bed:
      1. introduce or plant any plant or any part of any plant (whether exotic or indigenous) in, on, or under the bed:
        1. deposit any substance in, on, or under the bed:
          1. reclaim or drain the bed.
            1. The instruments referred to in subsection (1) are—

            2. a national rule; or
              1. a rule in a plan and any rule in a proposed plan that has legal effect; or
                1. a water services standard.
                  1. A person must not do any of the following activities in a manner that contravenes an instrument specified in subsection (4) unless the activity is expressly allowed by a permit or allowed by section 25:

                  2. enter onto or pass across the bed of a river or lake:
                    1. damage, destroy, disturb, or remove a plant or a part of a plant, whether exotic or indigenous, in, on, or under the bed of a lake or river:
                      1. damage, destroy, disturb, or remove the habitats of exotic or indigenous plants or parts of plants in, on, or under the bed of a lake or river:
                        1. damage, destroy, disturb, or remove the habitats of animals in, on, or under the bed of a lake or river.
                          1. The instruments referred to in subsection (3) are—

                          2. a national rule; or
                            1. a rule in a plan; or
                              1. a rule in a proposed plan that has legal effect; or
                                1. a water services standard.
                                  1. This section does not apply to any use of land in the coastal marine area.
