If a permit authority wants to review the conditions of a permit, you will get a notice. The notice must tell you which conditions are being reviewed and why. It must also say what information the authority used to decide to review the permit, unless the notice is given under section 186(1)(a) or (2). If you have to pay a charge for the review, the notice must tell you that and how much it might be. The authority may suggest new conditions for the permit and ask you to suggest some too, within 20 working days. If the authority has to tell others about the review, they must include a summary of the notice they sent you. They have to do this within 30 working days if you are invited to suggest new conditions, or within 10 working days if you are not.

187Notice of review

  1. A notice of intent to review the conditions of a permit under section 186

  2. must advise the permit holder of the conditions of the permit which are the subject of the review; and
    1. must state the reasons for the review; and
      1. must specify the information which the permit authority took into account in making its decision to review the permit, unless the notice is given under section 186(1)(a) or (2); and
        1. must advise a permit holder by whom a charge is payable under the regulations in relation to the review—
          1. of the fact that the charge is payable; and
            1. of the estimated amount of the charge; and
            2. may propose, and invite the permit holder to propose within 20 working days of service of the notice, new permit conditions.
              1. If notification of the review is required under section 188, the notification must include a summary of the notice served under this section, and the notification must be served within—

              2. 30 working days after the service of the notice (if the permit holder is invited to propose new conditions); or
                1. 10 working days after the service of the notice (if the permit holder is not invited to propose new conditions).
