If you hold a natural resource permit, you can give it up, either fully or partly, by sending a written notice to the permit authority. You do this by telling them in writing that you want to surrender your permit. The permit authority will then decide what to do with your request. If you want to give up only part of your permit, the permit authority might say no. They can refuse if giving up that part would affect the rest of the permit, or if it would stop you from meeting other conditions. They can also say no if giving up that part would harm natural resources or people. If you give up your permit, you are still responsible for anything you did wrong before giving it up. You also have to finish any work that you started under the permit, unless the permit authority tells you otherwise. When you give up your permit, it does not take effect until you get a notice from the permit authority saying they accept your surrender.

197Surrender of permit

  1. The holder of a natural resource permit may surrender the permit, either in whole or in part, by giving written notice to the permit authority.

  2. A permit authority may refuse to accept the surrender of part of a natural resource permit where it considers that the surrender of that part would—

  3. affect the integrity of the permit; or
    1. affect the ability of the permit holder to meet other conditions of the permit; or
      1. lead to an adverse effect on natural resources or people.
        1. A person who surrenders a natural resource permit remains liable under this Act—

        2. for any breach of conditions of the permit that occurred before the surrender of the permit; and
          1. to complete any work to give effect to the permit unless the permit authority directs otherwise in its notice of acceptance of the surrender under subsection (4).
            1. A surrender of a natural resource permit takes effect on receipt by the holder of a notice of acceptance of the surrender from the permit authority.
