The Governor-General can make rules to help regional councils review permits for using natural resources. You can think of these rules as a guide for councils to follow when they need to review permits. The Governor-General makes these rules after the Minister recommends them. The Minister must follow certain steps before recommending these rules, like they would for a proposed national instrument. You can find out more about what this means by looking at Part 3 of the Legislation Act 2019. This explains how rules like these are published. These rules are a type of secondary legislation, which is a law made under another law. You can learn more about secondary legislation in the Legislation Act 2019. The Minister has to make sure they follow the right process before the Governor-General can make these rules.

309Regulations

  1. The Governor-General may, by Order in Council made on the recommendation of the Minister, make regulations to prescribe a process by which a regional council may carry out a review of the conditions of a coastal, water, discharge, or land use permit that relates to the allocation of a natural resource use activity in the circumstances where a review is authorised or required to be carried out by a national instrument or a rule in a plan.

  2. Regulations made under this section are secondary legislation (see Part 3 of the Legislation Act 2019 for publication requirements).

  3. Before recommending the making of regulations under this section, the Minister must comply with section 313, as if the recommendation for regulations were for a proposed national instrument.
