102Subpart does not limit or affect chief executive’s powers

  1. The approval of a person does not affect or prevent the performance of a function under section 95 or the exercise of a power under this Act by the chief executive or affect the chief executive’s responsibility for the performance or exercise of those functions or powers.

  2. In particular, the chief executive may make any decision on any standards that they think fit regardless of whether—

  3. the decision is the same as, or different from, the advice or recommendation of an approved person; or
    1. the approved person has been involved in the development of the standards.
      1. This subpart does not limit the chief executive’s power to enter into any contract with any person or make any other arrangement for the purposes of performing the chief executive’s functions under section 95.
