74Limit on pecuniary penalty for multiple contraventions of same or substantially similar nature

  1. This section applies if—

  2. the court finds, whether in the same or separate proceedings, that a person is liable to pay a pecuniary penalty in respect of 2 or more contraventions of the same civil liability provision; and
    1. those contraventions are of the same or a substantially similar nature and occurred at or about the same time.
      1. The total amount of any pecuniary penalty imposed on the person in respect of those contraventions must not exceed the amount of the maximum pecuniary penalty that may be imposed in respect of a single contravention.
