62Exemption from requirement to be licensed directed by chief executive

  1. Subsection (2) applies if—

  2. an eligible person applies for an area to be licensed as a Customs-controlled area; and
    1. the chief executive considers that it is not in the public interest, or that it is impracticable or unnecessary, for the area to be licensed as a Customs-controlled area.
      1. The chief executive may direct that the area—

      2. need not be licensed as a Customs-controlled area; and
        1. is exempt from the provisions of this Act specified in the direction.
          1. A direction under subsection (2) may be given—

          2. in respect of the whole or any specified part of the business carried on in the area; and
            1. subject to any terms, conditions, or restrictions that the chief executive considers appropriate.
