183: Sale of certain seized goods

If you have goods that have been seized under section 178 and they have not yet been condemned, this section applies to you. The chief executive can sell certain things, like living creatures or things that will spoil or lose value if they are kept. The chief executive can also sell things if they think it is a good idea to do so. When the chief executive sells these goods, the money they get from the sale is used in place of the goods, and the same rules apply to the money. The money from the sale, after costs are taken out, is what is used in place of the goods that were sold.

183Sale of certain seized goods

  1. This section applies to goods that—

  2. have been seized under section 178; and
    1. have not yet been condemned.
      1. The chief executive may sell—

      2. a living creature; or
        1. any thing that, in the opinion of the chief executive,—
          1. is of a perishable nature; or
            1. is likely to deteriorate or diminish in value by keeping; or
              1. it is desirable to sell.
              2. The net proceeds of sale are substituted for the goods sold, and this subpart applies to the proceeds accordingly.
