If you have an interest in goods that have been seized under section 178, you can apply to the chief executive for a review of the seizure. You must apply in accordance with clause 1 of Schedule 5. The chief executive will review the seizure according to the rules set out in Schedule 5. You cannot apply for a review if the seized goods are tobacco or tobacco products that are prohibited from import under section 95A. The rules for reviewing seizures are in Schedule 5, which applies to reviews of seizures of goods.

184Application for review of seizure

  1. Any person who has an interest in goods that have been seized under section 178 may apply to the chief executive in accordance with clause 1 of Schedule 5 for a review of the seizure.

  2. Schedule 5 applies to reviews of seizures of goods.

  3. This section does not apply in respect of seized goods that are tobacco or tobacco products prohibited from import under section 95A.
