If you are a New Zealand publications official, you can import or export publications as part of your job without committing an offence under sections 388 to 390. This means you can bring publications into New Zealand or send them to an overseas official for work purposes.

You are considered a New Zealand publications official if you are referred to in section 131(4)(a) to (l) of the Films, Videos, and Publications Classification Act 1993. An overseas publications official is someone in another country who has a similar job to yours and is doing the work that comes with that job, as described in section 131(4)(a) to (l) of the Films, Videos, and Publications Classification Act 1993.

392Publications imported or exported in course of official duties

  1. It is not an offence for the purposes of sections 388 to 390 for a New Zealand publications official to do the following for the purpose of, and in connection with, his or her official duties:

  2. import a publication (whether with the involvement of an overseas publications official or not):
    1. export a publication to an overseas official.
      1. In this section,—

        New Zealand publications official means a person referred to in section 131(4)(a) to (l) of the Films, Videos, and Publications Classification Act 1993

          overseas publications official means a person in a country other than New Zealand who—

          1. holds an office in that country that corresponds to an office referred to in section 131(4)(a) to (1) of the Films, Videos, and Publications Classification Act 1993; and
            1. is carrying out the functions of that office

              publication has the meaning given to that term in section 2 of the Films, Videos, and Publications Classification Act 1993.
