If you are in charge of a craft, you commit an offence if you do not follow the rules in section 17(1) or (2). You can get in trouble if you break these rules. If you are found guilty, you could go to prison for up to 12 months or get a fine of up to $15,000.

If you are not a Customs officer and you do not follow the rules in section 17(3), you also commit an offence. You can get a fine of up to $5,000 if you are found guilty.

18Offences in relation to craft that arrive at place other than Customs place, etc

  1. The person in charge of a craft commits an offence if the person fails to comply with section 17(1) or (2).

  2. A person who commits an offence under subsection (1) is liable on conviction to—

  3. imprisonment for a term not exceeding 12 months; or
    1. a fine not exceeding $15,000.
      1. A person (other than a Customs officer) commits an offence if the person fails to comply with section 17(3).

      2. A person who commits an offence under subsection (3) is liable on conviction to a fine not exceeding $5,000.
