If you are in charge of a craft, you commit an offence if you do not follow the rules in section 12(1) to (3) or a direction from a Customs officer under section 12(3). You can get in trouble if you do not do what you are supposed to do. This can lead to serious consequences.

If you commit this offence, you can be imprisoned for up to 12 months or fined up to $15,000 when you are convicted. This is a serious penalty for not following the rules. You need to be aware of the consequences of your actions.

You also commit an offence if you give Customs wrong or misleading information in your advance notice of arrival under section 12(1) or supporting documents under section 12(2)(b). This includes providing false or fake information. You must provide accurate and genuine information.

If you commit this offence, you can be punished when you are convicted. As an individual, you can be imprisoned for up to 12 months or fined up to $15,000. As a company, you can be fined up to $75,000.
