53A: Power to collect information designated as arrival information

When you arrive in New Zealand, Customs can collect information from you. They can do this to check if you are following a rule from another law. The information they collect must be designated as arrival information by that other law.

The law that allows Customs to collect this information lists which rules they can check. You must follow the rule before or when you arrive in New Zealand. Customs can only collect the information if it is listed in the law.

53APower to collect information designated as arrival information

  1. Customs may collect information from a person to verify their compliance with a requirement under another Act if—

  2. the information is designated as arrival information by 1 or more provisions of that Act (the relevant provisions); and
    1. the relevant provisions are listed in subsection (2); and
      1. the person must comply with the requirement before or when they arrive in New Zealand.
        1. There are no relevant provisions for the purpose of this section as enacted.

        2. Section 28A does not apply to information designated as arrival information for the purposes of this section (see the relevant provisions for requirements relating to how and when the information is to be provided).
