58: Revocation of suspension or change to individual scope of practice

The Board must tell the Registrar to lift a suspension of a social worker as soon as they are satisfied that you are able to work properly as a social worker. This can happen if you were always able to work properly or if you are now able to work properly again. The Board makes this decision based on sections section 57 or 57A of the Social Workers Registration Act.

The Board must also tell the Registrar to reverse any changes made to what you are allowed to do as a social worker under section 57 or 57A if they think those changes are no longer needed. The Registrar then has to make sure you get a copy of this decision within 5 working days.

The decision to lift the suspension or change what you can do takes effect right away.

58Revocation of suspension or change to individual scope of practice

  1. The Board must give the Registrar a direction to revoke a suspension imposed under section 57 or 57A as soon as practicable after the Board is satisfied that the social worker concerned—

  2. was in fact able to practise satisfactorily as a social worker; or
    1. is again able to practise satisfactorily as a social worker.
      1. The Board must give the Registrar a direction to revoke any change made to the individual scope of practice of the social worker under section 57 or 57A as soon as practicable after the Board is satisfied that the change is no longer necessary.

      2. The Registrar must take all reasonably practicable steps to ensure that a copy of the direction is given to the social worker within 5 working days after the day on which it is given.

      3. The direction takes effect immediately.
