If a decision or direction made by the Board under the Social Workers Registration Act affects you badly, you can appeal to the District Court. You can appeal against the whole or part of a decision or order made about you under Part 4, except for a decision made by a professional conduct committee. For example, a decision can be a refusal to make an order, and an order can include a direction under section 77. You must lodge your appeal within 20 working days after you are told about the decision or order, or you can ask a District Court Judge for more time. You do this by giving a notice of appeal, which follows the rules of court.

88Rights of appeal

  1. A person may appeal to the District Court against any decision or direction of the Board under this Act that adversely affects the person (not being a decision or direction affecting a person only because the person is a person of a particular kind or description).

  2. A person may appeal to the District Court against the whole or any part of a decision or order made in relation to the person under Part 4 (other than a determination of a professional conduct committee).

  3. For the purposes of subsection (2),—

  4. a decision includes a decision to refuse to make an order; and
    1. an order includes a direction under section 77; and
      1. a decision or order made in relation to a charge laid by the Director of Proceedings or a professional conduct committee is made in relation to the Director of Proceedings or a professional conduct committee (as well as any other person).
        1. The appeal—

        2. must be brought by way of notice of appeal in accordance with rules of court; and
          1. must be lodged within 20 working days after notice of the decision or order is communicated to the appellant, or within any further time a District Court Judge allows on application made before or after the period expires.
