91: Procedure on appeal

When you appeal a decision under this Part, the appeal will be heard as soon as possible after it is lodged. The District Court will then make a decision on your appeal, and they can confirm, reverse, or modify the original decision or order. They can also make any other decision or order that the original person or body could have made.

The District Court will only look at the parts of the decision or order that you are appealing against. They will not review any parts of the decision or order that you are not appealing against. They also will not look at any decisions or orders that you did not appeal against at all.

91Procedure on appeal

  1. An appeal under this Part must be heard as soon as is reasonably practicable after it is lodged.

  2. On hearing the appeal, the District Court

  3. may confirm, reverse, or modify the decision or order appealed against; and
    1. may make any other decision or order that the person or body that made the decision or order appealed against could have made.
      1. The District Court must not review—

      2. any part of a decision or order not appealed against; or
        1. any decision or order not appealed against at all.
