194Membership of Committee

  1. The size of the Committee must be determined by the Prime Minister in consultation with the Leader of the Opposition, but the Committee must comprise—

  2. a minimum of 5 members; and
    1. a maximum of 7 members.
      1. The membership of the Committee must comprise—

      2. the Prime Minister; and
        1. the Leader of the Opposition; and
          1. members of the House of Representatives nominated by the Leader of the Opposition, with the agreement of the Prime Minister, after consultation with the leader of each party that is not in government or in coalition with a Government party; and
            1. members of the House of Representatives nominated by the Prime Minister after consultation with the leader of each party in government.
              1. If it is determined that the Committee should comprise 5 members,—

              2. 1 member must be nominated under subsection (2)(c); and
                1. 2 members must be nominated under subsection (2)(d).
                  1. If it is determined that the Committee should comprise 6 or 7 members,—

                  2. 2 members must be nominated under subsection (2)(c); and
                    1. the balance of the members must be nominated under subsection (2)(d).
                      1. When nominating a person for membership of the Committee, the Leader of the Opposition and the Prime Minister must have regard to security requirements and the proportional representation of political parties in the House of Representatives.

                      2. When performing the Committee’s functions, a member of the Committee acts in his or her official capacity as a member of Parliament.
