25: Request for assistance to acquire, use, and maintain assumed identity

The Director-General of an intelligence and security agency can ask another agency for help. You might need help to get a new identity, use a new identity, or keep a new identity. The Director-General can ask for help with one or more of these things for someone who is allowed to do secret work.

When the Director-General asks for help, they must give some details. They need to say who the person is that needs help, what new identity they are getting, and what kind of help they need from the other agency. They also need to say what proof they need to show that the new identity is real.

The Director-General must also confirm why they are asking for help. They can only ask for help for the reasons stated in section 21. This means they need to make sure their request is for one of those allowed reasons.

25Request for assistance to acquire, use, and maintain assumed identity

  1. The Director-General of an intelligence and security agency may request any other agency to assist an authorised person to do 1 or more of the following:

  2. acquire an assumed identity:
    1. use an assumed identity:
      1. maintain an assumed identity.
        1. A request must—

        2. provide details of—
          1. the authorised person that are necessary to enable the agency to provide the assistance; and
            1. the assumed identity being acquired (or that has been acquired) for the authorised person; and
              1. the assistance being sought from the agency; and
                1. the specific evidence of the assumed identity that the agency is requested to issue or give; and
                2. confirm that the request is made for either or both of the purposes specified in section 21.
