When a new Parliament starts, the Prime Minister must tell the House of Representatives who they think should be on the Intelligence and Security Committee. The Prime Minister gets these names from nominations made under section 194(2)(c) and (d) and section 195, if there are any. The House of Representatives then decides if they agree with these choices.

If the House of Representatives does not agree with a nomination, the Prime Minister must suggest another person for the Committee. This new person is chosen by the Leader of the Opposition under section 194(2)(c), or by the Prime Minister under section 194(2)(d), depending on the situation. 196Endorsement of nominated members

  1. The Prime Minister must, as soon as practicable after the commencement of each Parliament, present to the House of Representatives, for endorsement as members of the Committee, the names of the members of the House of Representatives nominated under—

  2. section 194(2)(c) and (d); and
    1. section 195 (if any).
      1. If the House of Representatives declines to endorse any nomination, the Prime Minister must present to the House of Representatives, for endorsement as a member of the Committee, the name of another member of the House of Representatives nominated by the Leader of the Opposition under section 194(2)(c), or the Prime Minister under section 194(2)(d), as the case requires.
