43: Immunity of persons complying with request or direction

If you do something or do not do something because you are following a request made under section 35, 37, or 42, you are protected from getting in trouble. You must do it in good faith and with reasonable care. This means you will not be liable for what you did or did not do.

If you are following a direction given under section 38, you are also protected from getting in trouble. You must still do it in good faith and with reasonable care. This protection is from both civil and criminal liability.

43Immunity of persons complying with request or direction

  1. A person is protected from civil and criminal liability, however it may arise, in relation to any act that the person does, or omits to do, in good faith and with reasonable care in the course of complying with—

  2. a request made under section 35, 37, or 42; or
    1. a direction given under section 38.
