You can access some information directly if you work for a certain intelligence and security agency. This agency must be listed in the first column of Schedule 2. The information you can access is listed in the second column of Schedule 2 next to your agency's name. This information is held by another agency, which is listed in the third column of Schedule 2.

You can only access this information if there is a written agreement between the Minister in charge of the agency that holds the information and the Minister in charge of your intelligence and security agency.

This written agreement is called a direct access agreement and it must be followed when accessing the information.

125Direct access to certain information

  1. An intelligence and security agency specified in the first column of Schedule 2 may have direct access to the information specified in the second column of Schedule 2 that is opposite its name and held by the holder agency specified in the third column of Schedule 2.

  2. However, that access must be in accordance with a written direct access agreement entered into between—

  3. the Minister responsible for the holder agency; and
    1. the Minister responsible for the intelligence and security agency.
