If you get an intelligence warrant under section 71, it will be cancelled after 48 hours unless you apply for a Type 1 intelligence warrant under section 55 before then. When you make this application, the Minister and a Commissioner of Intelligence Warrants can decide to confirm your warrant or cancel it. If they confirm it, your warrant will be treated like a Type 1 intelligence warrant issued under section 58 or section 59 from the date it was first issued.

74Intelligence warrant issued under section 71 revoked unless confirmed

  1. An intelligence warrant issued under section 71 is revoked by the operation of law 48 hours after its issue unless, before the expiry of that period, the applicant has made an application under section 55 for the issue of a Type 1 intelligence warrant.

  2. On an application made under section 55, the authorising Minister and a Commissioner of Intelligence Warrants may—

  3. confirm the urgent intelligence warrant, and that warrant must then be treated as a Type 1 intelligence warrant issued under section 58 or 59 (as the case may be) on the date on which the urgent intelligence warrant was issued; or
    1. revoke the intelligence warrant issued under section 71.
