92P: Medical officer of health must review directions

A medical officer of health is responsible for reviewing directions in their health district. You need to know they must check each direction to see if it is still needed. They do this by looking at whether the direction is still required and if the person it affects is still a public health risk.

If the medical officer of health thinks the person is no longer a risk, they can cancel the direction under section 92S. The medical officer of health must also tell the Director-General why a direction needs to continue if the Director-General asks them to.

The medical officer of health has to do these reviews regularly to make sure directions are fair and necessary.

92PMedical officer of health must review directions

  1. A medical officer of health must—

  2. regularly review each direction that is in effect in the health district or districts for which the officer is responsible; and
    1. consider whether the direction is still required; and
      1. rescind the direction under section 92S if he or she is satisfied that the individual no longer poses a public health risk; and
        1. if directed by the Director-General to do so, advise the Director-General why the direction needs to continue in effect.
