Health Act 1956

Management of infectious diseases - Appeals and enforcement

92ZW: Offence not to comply with order

You could also call this:

"Breaking a health order can get you in trouble with the law"

If you do not follow an order made under this Part of the law, you can get in trouble. You must have a good reason for not following the order, or you will commit an offence. If you intentionally do not follow the order, you can be punished.

If you commit this offence, you might go to prison for up to 6 months or have to pay a fine of up to $2,000. The District Court will decide what happens to you.

The District Court can also make a special order under sections 92Z or 92ZH instead of punishing you. This does not change the court's power to punish you if you do not follow a court order, which can be seen as contempt of court.
