116I: Local authority must comply with direction

If you are a local authority and you get a direction under section 116E, you must follow the direction. You can find more information about what you have to do if you do not get a direction in Part 1 of Schedule 1AA. If the direction says you have to add fluoride to drinking water, you must make sure the right amount of fluoride is in the water before people drink it.

If the direction tells you to add fluoride to drinking water, you have to take all practical steps to ensure the water has the specified level of fluoride in it before people can drink it. This rule does not apply to certain sites that are specified under section 116F(3). You must follow the rules to make sure the drinking water is safe for people to drink.

116ILocal authority must comply with direction

  1. A local authority that receives a direction under section 116E must comply with the direction. (See Part 1 of Schedule 1AA for the obligations of a local authority that does not receive a direction.)

  2. If the direction requires fluoride to be added to drinking water, the local authority must take all practicable steps to ensure that the specified level of fluoride is present in the water immediately before it is available for consumption.

  3. Subsection (2) does not apply to a site specified under section 116F(3).
