You commit an offence if you do not follow the rules without a good reason. You must comply with the requirements of section 112Y(3)(e) or (4)(b) or 112Z. You must not access or use information in a way that is not allowed by section 112J(1) or 112Y(1).

You must make available any information or specimens that you are required to under sections 112ZB, 112ZC, and 112ZD. If you do not do this, you can be fined up to $10,000 if you are found guilty.

112ZPOffences

  1. Every person commits an offence against this Act who, without reasonable excuse,—

  2. fails to comply with the requirements of section 112Y(3)(e) or (4)(b) or 112Z; or
    1. accesses, uses, retains, or discloses any NCSP information or evaluation material in contravention of section 112J(1) or 112Y(1); or
      1. amends any information stored on the NCSP register, without authority from the NCSP manager under section 112JA(4).
        1. Every person commits an offence against this Act who, without reasonable excuse, fails to make available any information or specimens that the person is required to make available under any of sections 112ZB, 112ZC, and 112ZD.

        2. Every person who commits an offence under subsection (2) is liable on conviction to a fine not exceeding $10,000.
