175: Inspection of railways

You can’t use a new railway until it’s been checked to make sure it’s safe. The Minister of Transport has to choose someone to inspect the railway. This person will look at all of the new part of the railway. If it’s a brand new railway, and not just an extension of an old one, they’ll also check all the trains and carriages that will run on it.

The inspector needs to make sure everything is in good condition and working well. They have to tell the Minister of Transport that the railway and all the vehicles are safe for people to use. Only after the inspector says it’s all okay can the railway open for people to travel on.

175Inspection of railways

  1. No part of any railway constructed by the Minister of Transport under this Act or under any other Act relating to the construction of public works or railways shall be opened for traffic until—

  2. it has been inspected by some proper person appointed by the Minister of Transport for that purpose; and
    1. that person has reported to the Minister of Transport that he has inspected—
      1. the whole of that part; and
        1. except in the case of an extension of an existing railway, all the rolling stock to be used on it—
        2. and that the railway and rolling stock are in good and efficient repair and may be safely and conveniently used for public traffic.
