243: Regulations

The Governor-General can make rules called regulations about public works. These rules can do several things:

They can decide what kinds of vehicles can use motorways and how they should be used. They can also set rules for keeping motorways safe and in good condition.

The regulations can set fees for things like preparing documents or other activities related to public works. They can also set fees for getting permission to use public land.

These regulations can set interest rates for money owed under this law. They can also cover any other things needed to make this law work properly.

243Regulations

  1. The Governor-General may from time to time, by Order in Council, make regulations for all or any of the following purposes:

  2. classifying traffic and motorways, and permitting and regulating, or prohibiting, the use of motorways by any class or classes of traffic:
      1. generally providing for the control, protection, and proper use of motorways:
          1. prescribing the fees payable by any government department, local authority, or any other body corporate or person in respect of—
            1. preparing, checking, processing and, where applicable, gazetting any document:
              1. any other regulatory activity that any department of State is authorised to undertake under this Act:
                1. prescribing the fees payable for the granting of any lease, licence, permit, or other authority under this Act or under any regulations in force under this Act:
                  1. prescribing rates of interest to be paid under any provision of this Act:
                    1. providing for such matters as are contemplated by or necessary for giving full effect to this Act and for its due administration.
                      1. Regulations made under this Act may be made so as to apply generally throughout New Zealand or within any specified part or parts of New Zealand, or within the whole of New Zealand except such part or parts as may be specified in the regulations, and may be made so as to apply to all motorways or to any class or classes of motorways or to any motorway or part of it, and may provide for the exemption of any class or classes of motorways or of any motorway or part of it.

                      2. Regulations under this section are secondary legislation (see Part 3 of the Legislation Act 2019 for publication requirements).
