93: Costs in claims withdrawn or abandoned

When you make a claim for compensation, but later decide to withdraw it or give up on it (either completely or partly), the Land Valuation Tribunal can still decide who should pay for the costs of the claim. They can do this in the same way as if they had actually heard and decided on your claim. If the Tribunal decides to award costs, these costs will be handled and enforced in the same way as if it was compensation money.

The award

93Costs in claims withdrawn or abandoned

  1. When any claim for compensation is at any time after its making withdrawn or abandoned, whether wholly or in part, costs may be awarded by the Land Valuation Tribunal in respect of that claim or that part of it in the same manner as if the claim or part had been heard and determined by the Tribunal; and any such award of costs shall be dealt with and enforced in the same manner as an award of compensation.
