When part of a rented property is taken for public works, the rent for that property may need to be adjusted. You and your landlord can agree on how much the rent should be reduced. If you can’t agree, a special group called the Tribunal will decide. They will look at how much of the property’s value was lost because of the public works. The rent will be reduced by the same percentage as the value that was lost. For example, if the part taken was worth 20% of the whole property’s value, your rent would be reduced by 20%.

101Land on which rent payable

  1. If the land in respect of which compensation is awarded or compensation or purchase money is paid is part of land in respect of which any rent is payable—

  2. the lessor and lessee may agree; or
    1. failing agreement, the Tribunal shall determine—
      1. what part of that rent shall cease to be payable, so that the rent ceasing to be payable shall bear the same proportion to the whole rent as the value of the land in respect of which compensation is awarded or compensation or purchase money is paid bears to the value of the whole land.
