207: When and how poll to be taken

When a poll is needed for an irrigation scheme, here’s how it works:

The person in charge will tell you when the poll will happen. They’ll put this information in a notice. The poll day will be between 10 and 20 working days after they publish this notice. It will also be between 3 and 12 months after they first told everyone about the irrigation scheme plan.

On the day of the poll, your local council will run the voting. They’ll do this in a way that’s similar to other local elections, but the Minister might give them special instructions.

If the poll doesn’t happen at the same time as other local elections, the government might pay for it. If it does happen at the same time, the government might pay for the extra costs.

If there’s a disagreement about how much the government should pay, a special person called the Controller and Auditor-General will decide. Their decision is final.

207When and how poll to be taken

  1. The day on which any poll under this Part shall be taken shall be the day specified in that behalf in the notice published under section 206, which day shall be—

  2. not less than 10 working days nor more than 20 working days after the date of the publication of the notice; and
    1. not less than 3 months nor more than 12 months after the date of public notification under section 200 of the investigation of the proposed irrigation scheme.
      1. On the day so specified a poll shall be taken by each territorial authority whose district or part of it is included in the proposed irrigation district, and, subject to any necessary modifications and to any direction given by the Minister, the poll shall be taken in the manner provided under the Local Electoral Act 2001.

      2. The reasonable cost of every poll under this Part that is not held simultaneously with the election of members of any local authority, and the reasonable additional costs incurred by a local authority for any poll under this Part that is held simultaneously with the election of members of the local authority, may be paid by the Crown out of money appropriated by Parliament for the purpose.

      3. Any dispute arising as to the amount to be paid by the Crown to any local authority under this section shall be determined by the Controller and Auditor-General after such inquiry as he thinks fit to make, and the decision of the Controller and Auditor-General in any such dispute shall be final.
