47Speaker may request Public Service Commissioner to perform certain functions under Public Service Act 2020

  1. The Speaker may request the Public Service Commissioner to perform for a parliamentary agency the functions conferred on the Commissioner by section 44(b) to (e) of the Public Service Act 2020.

  2. If the Public Service Commissioner accepts the request, the Commissioner must perform those functions in a way that is appropriate to the role of the parliamentary agency and its separation from the executive government.

  3. For the purposes of this section, section 44(b) to (e) of the Public Service Act 2020 applies, with all necessary modifications, as if—

  4. the parliamentary agency were a department; and
    1. the head of the parliamentary agency were the chief executive of that department.
      1. In this section, Public Service Commissioner means the Public Service Commissioner appointed under section 42 of the Public Service Act 2020.
