If you are appointed to act as Clerk, you can perform tasks and make decisions as if you were the actual Clerk. When you do these tasks or make decisions, it is assumed you have the authority to do so. If the Clerk is away for more than three months, special rules apply. You need to follow the rules in section 110, which you can read about in the link to section 110(1). If the Clerk is away for this long, any previous appointments made under section 110(2) must be approved by the Governor-General to continue. Also, no new appointments can be made under section 110(2) without the Governor-General's approval.

111Further matters applying to acting Clerk

  1. If a person appointed to act as Clerk performs a function or duty or exercises a power of the Clerk, the performance of the function or duty or the exercise of the power is conclusive evidence that the person is authorised to perform that function or duty or exercise that power.

  2. If the circumstances described in section 110(1) apply for a period of more than 3 months’ duration,—

  3. no earlier appointment made under section 110(2) may continue except with the approval of the Governor-General; and
    1. no further appointment may be made under section 110(2) except with the approval of the Governor-General.
