Local Government Act 1974

Divestment of land drainage schemes and water race schemes - Transfer petitions and transfer proposals

517L: Notice of right to object

You could also call this:

"Telling you about your right to disagree with a proposal that affects your water or drainage system"

Illustration for Local Government Act 1974

When a local authority gets a transfer petition and proposal, they must send a notice to certain people. You will get this notice if you use a drainage or water supply system that is part of the proposal. The local authority must send the notice as soon as they can after they get the proposal.

The notice must also go to every other user of the system and to local authorities that have the right to object to the proposal under section 517K(c). You will get the notice so you know about the proposal and your right to object. The notice must follow the rules set out in section 517M.

The local authority must send the notice to you if you are a user of the system or if you are a local authority that can object to the proposal under section 517K(c). This is so you can have your say about the proposal. The notice is an important part of the process, and it must be sent after the local authority gets the proposal under section 517E, unless section 517F(3) applies.
