Local Government Act 1974

Urban renewal

644F: Acquisition of land by council where house unfit for habitation or area below minimum

You could also call this:

"Council can take land if house is unfit or land is too small"

Illustration for Local Government Act 1974

If a house is not fit for people to live in, or the area of land is too small, the council can take over the land. You should know that this rule is part of the law about urban renewal in the Local Government Act 1974. The council's power to do this was stopped on 1 July 2003 by section 266 of the Local Government Act 2002.

The rule used to say that the council could acquire the land in these situations, but it is no longer in effect. This change happened because of the Local Government Act 2002, which made some changes to the law. You can find more information about the change that stopped this rule by looking at the Local Government Act 2002.
