When a local authority gets objections to a transfer proposal, they must check if they have received any written objections within 7 days after the closing date. You can find out more about lodging written objections under section 517K. The local authority must see if they have received objections from certain groups, including other local authorities, operators of drainage or water supply systems, and scheme users who occupy at least 5% of the properties served by the scheme.

The local authority must then tell the person who made the proposal, all scheme users, and every local authority that might be affected by the proposed transfer, whether they have to send the proposal and objections to the Commission. 517PNotification by local authority of receipt of objections

  1. Within 7 days after the closing date for the lodging of written objections under section 517K, the local authority—

  2. must ascertain whether it has received any written objections from—
    1. any local authority entitled under section 517K(c) to object to the transfer proposal; or
      1. the operator of any other drainage system or water supply system that utilises the scheme; or
        1. scheme users who are occupiers of not less than 5% of the number of separately rateable properties served by the land drainage scheme or water race scheme; and
        2. must advise the proposer and all other scheme users and every local authority within whose district the scheme is wholly or partly situated or which is otherwise likely to be affected by the proposed transfer, whether or not, as a result of its finding under paragraph (a), the local authority is required by section 517S to forward to the Commission the transfer proposal and every objection received by the local authority.
