2C: Determination of permit tier status

Illustration for Crown Minerals Act 1991

When you get a permit, the Minister decides what tier it is. The Minister does this when they first give you the permit. They also do this if your permit is changed under section 36(1).

The Minister can decide to change the tier of your permit at any other time they think is right. They have the power to make this decision whenever they want. But there is one important rule: the Minister cannot change a Tier 3 permit to a Tier 2 permit.
