The Minister can choose some land owned by a local authority to be a gold fossicking area. You can find out about this in the Gazette, which is like a special newspaper. The Minister does this when a local authority asks them to. The notice in the Gazette must say that the area is open for people to look for gold, where the area is, and that you can only use handheld tools that do not use motors to mine for gold. The notice must also say what other rules you have to follow when you are looking for gold in that area, which the Minister and the land owner agree on. If the local authority asks the Minister to stop the land being a gold fossicking area, the Minister must do so.

98AGold fossicking areas (other land)

  1. The Minister may, by notice in the Gazette given on the request of a local authority, designate any land owned by the authority as a gold fossicking area.

  2. The notice must—

  3. state that the area is open for public fossicking in respect of gold; and
    1. specify the area and its general location; and
      1. state that a person has the right to mine for gold in the area by means only of non-motorised hand held tools; and
        1. state any other terms or conditions that apply when a person is fossicking in the area (as agreed between the Minister and the owner of the land).
          1. The Minister must revoke a designation made under subsection (1) if requested to do so by the authority.
