When you apply for a permit, the Minister has to consider some things. If you have had a permit before or currently have one, and you had to write a report about how you worked with iwi or hapū under section 33C, the Minister will look at that report. The Minister will also look at what you are applying for now and if it needs another report about working with iwi or hapū under section 33C.

Before the Minister gives you a permit, they have to think about what iwi or hapū said about how you worked with them in the past. The Minister must consider the feedback from reports and meetings about your past engagement with iwi or hapū. The Minister can also think about any other feedback from iwi or hapū about your past engagement with them.

29CMinister’s functions in relation to feedback from iwi or hapū when considering application

  1. This section applies if—

  2. the applicant is a previous or current permit holder or a previous or existing privilege holder; and
    1. the applicant, in their capacity as a previous or current permit holder or a previous or existing privilege holder, is or was required to submit an iwi engagement report or reports under section 33C; and
      1. the applicant is applying for a permit for which an iwi engagement report is required under section 33C.
        1. If this section applies, before granting a permit, the Minister—

        2. must have regard to feedback provided in iwi engagement reports and at annual review meetings about the quality of the applicant’s previous engagement with iwi or hapū in the applicant’s capacity as a previous or current permit holder or a previous or existing privilege holder; and
          1. may have regard to any other feedback from iwi or hapū about the quality of the applicant’s previous engagement with iwi or hapū, in the applicant’s capacity as a previous or current permit holder or a previous or existing privilege holder.
