The Minister can exempt you from doing post-decommissioning work if they think it is appropriate and you meet the criteria in section 89ZZB(1). The Minister can grant an exemption with any terms and conditions they consider appropriate. They can also amend or revoke an exemption, grant it for a limited or indefinite period, or replace it before or when it expires.

The Minister must provide a summary of reasons for their decision and include it in the notice of exemption. If you are exempt, the Minister will tell you why they made that decision.

You can also get a class exemption through regulations, which is explained in section 105.

89ZZAExemption powers of Minister

  1. The Minister may, if they consider it appropriate and if satisfied that the criteria in section 89ZZB(1) are satisfied, exempt a permit holder or a licence holder from the obligation to carry out and meet the costs of any post-decommissioning work.

  2. The Minister—

  3. may grant an exemption on any terms and conditions that the Minister considers appropriate:
    1. may amend or revoke an exemption:
      1. may grant an exemption for an indefinite or a limited period:
        1. may replace an exemption either before or when it expires:
          1. must provide a summary of reasons for a decision under paragraphs (a) to (d) and include that summary in the notice of exemption.
            1. Class exemptions may be granted by regulations (see section 105).
