If you have to decommission something like a well or petroleum infrastructure, you also have to do any extra work that is needed after it is decommissioned. You have to pay for this work too. This extra work is called post-decommissioning work. You are responsible for this work forever. If you are a company, you must tell the chief executive if someone new is in charge of your company or if your company moves to a new location. You must also send any reports about the post-decommissioning work to the Minister as soon as you get them, according to section 89J(1), 89K(1), 89R(1), or 89S(1).

89ZVPost-decommissioning obligations

  1. Any person who is obliged under section 89J(1), 89K(1), 89R(1), or 89S(1) to carry out and meet the costs of decommissioning must carry out, and meet the costs of, any post-decommissioning work required on petroleum infrastructure or, as the case requires, 1 or more wells that have been decommissioned.

  2. The liability created by subsection (1) continues indefinitely.

  3. Every person who is obliged under subsection (1) to carry out and meet the costs of post-decommissioning work must,—

  4. if the person is a body corporate, notify the chief executive as soon as practicable after—
    1. any change of control of the body corporate:
      1. any change in the place where the body corporate is registered or has its head office:
      2. after receiving any monitoring report or documents relating to post-decommissioning remediation work, promptly send the report or documents to the Minister.
