89ZZZC: Effects of subparts 2 and 3 on Crown liability

You could also call this:

"How subparts 2 and 3 affect what the government must do or pay for when oil and gas work is finished."

Illustration for Crown Minerals Act 1991

When you look at subparts 2 and 3 of this Part, you will see they are about decommissioning and post-decommissioning obligations. These subparts do not mean the Crown has to do or pay for the decommissioning of petroleum infrastructure or wells, or post-decommissioning work. The Crown is still responsible for decommissioning under other laws or agreements, and this does not change that.

The Crown may still be liable under other enactments, rules of law, or agreements, even if subparts 2 and 3 do not require them to undertake or pay for decommissioning. This means the Crown's liability is not affected by these subparts. You can find more information about this in the Crown Minerals Act 1991, specifically in subparts 2 and 3.

You should note that the Crown Minerals (Decommissioning and Other Matters) Amendment Act 2021 made some changes to this area of law.
