The Water Services Authority must talk to certain groups before making a recommendation under section 97F. You will be part of this process if you are a water service provider, a water services industry representative body, the Commerce Commission, or a central government agency that gives advice on water services infrastructure. The Authority will choose which central government agencies to talk to. The Authority must give these groups enough notice about what the draft NEDS says. They must also give them a fair chance to make submissions and consider any submissions they get. But the Authority does not have to talk to these groups if they think a change to the NEDS needs to be made urgently for safety reasons, to deal with transitional issues, or if the change is minor and will not hurt anyone's interests.

97EDraft NEDS: consultation

  1. Before making a recommendation under section 97F, the Water Services Authority must consult the following in relation to a draft of the proposed NEDS:

  2. water service providers:
    1. water services industry representative bodies:
      1. the Commerce Commission:
        1. any central government agency that is responsible for providing advice and guidance on water services infrastructure and that the Water Services Authority considers appropriate.
          1. Consultation must include—

          2. adequate and appropriate notice of the content of the draft NEDS; and
            1. a reasonable opportunity for the entities listed in subsection (1) to make submissions; and
              1. appropriate consideration of any submissions received.
                1. However, the Water Services Authority need not consult the entities listed in subsection (1) if it is satisfied that a proposed amendment to the NEDS—

                2. needs to be made—
                  1. urgently for safety reasons; or
                    1. to deal with transitional issues; or
                    2. is minor and will not adversely and substantially affect the interest of any person.
