The Water Services Authority can appoint someone as a compliance officer by giving them a written notice. You can be a compliance officer if you are an employee of the Water Services Authority, or an employee of a department as defined in the Public Service Act 2020. You can also be a compliance officer if you are suitably qualified and trained, or if you belong to a group of people who are suitably qualified and trained. A compliance officer's powers are subject to any conditions or limitations specified in their appointment notice. If a compliance officer does not follow these conditions, their actions are still valid.

98Appointment of compliance officers

  1. The Water Services Authority may, by notice in writing, appoint any of the following as a compliance officer:

  2. an employee of the Water Services Authority:
    1. an employee of a department (within the meaning of the Public Service Act 2020):
      1. an employee of the State services (within the meaning of the Public Service Act 2020):
        1. any other person who the Water Services Authority is satisfied—
          1. is suitably qualified and trained:
            1. belongs to a class of persons who are suitably qualified and trained to exercise any or all of the powers of, and carry out any or all of the duties of, a compliance officer.
            2. A compliance officer’s compliance powers are subject to any conditions or limitations specified in the notice of the officer's appointment.

            3. However, the exercise of a compliance power by a compliance officer is not invalid merely because it did not comply with the conditions specified in the notice of the officer’s appointment.
