146Record-keeping requirements for monitoring and reporting purposes

  1. The Water Services Authority may, by notice, require network operators to keep and maintain records relating to compliance with applicable—

  2. environmental performance measures; and
    1. environmental performance targets; and
      1. for wastewater network operators, wastewater environmental performance standards and the requirements of wastewater network risk management plans; and
        1. for stormwater network operators, stormwater environmental performance standards.
          1. Network operators must—

          2. keep and maintain the records required by the notice; and
            1. make the records available to the Water Services Authority in any format specified in the notice.
              1. For the purpose of ensuring that a network operator complies with subsection (1), the Water Services Authority may require the network operator to provide the Water Services Authority with either or both of the following types of information:

              2. a written statement as to whether the network operator has complied with subsection (1):
                1. information that will enable the Water Services Authority to determine whether the network operator has complied with subsection (1).
                  1. In addition to the information specified in subsection (2A), the Water Services Authority may require the network operator to provide a certificate to confirm that the information provided under this section is accurate and complete.

                  2. A certificate under subsection (2B) must—

                  3. be in the form specified by the Water Services Authority; and
                    1. be signed by—
                      1. the network operator’s chief executive; or
                        1. at least 1 board member or director of the network operator; or
                          1. if the network operator has no board or director, a person occupying a position that is comparable to a board member or director.
                          2. The Water Services Authority may require information to be provided under subsection (2A) only if the network operator is—

                          3. a territorial authority; or
                            1. a water organisation; or
                              1. a government department; or
                                1. the New Zealand Defence Force.
                                  1. A notice made under subsection (1) is secondary legislation (see Part 3 of the Legislation Act 2019 for publication requirements).
